If voluntary dedication is not <br /> possible, recommend payment- in- lieu of $1 , 096 <br /> (3/20th of acre x $7,310/acre - 1987 valuation) . <br /> (3) Show location of 100-year flood plain boundary <br /> adjacent to Prices Creek and provide notation, <br /> "Use of land within a floodway or floodway <br /> fringe is substantially restricted by the Orange <br /> County Flood Damage Prevention Ordinance. " <br /> (4) Calculate stream buffer as required by Article <br /> 6.23. 1 of the Zoning Ordinance and show location <br /> of stream buffer boundary, including the <br /> notation, "No building or structures are <br /> permitted within the stream buffer as shown <br /> hereon, and the stream buffer shall remain in <br /> its natural state as required by the Orange <br /> County Zoning Ordinance. <br /> The application for preliminary subdivision plan <br /> approval was received on January 30, 1987 . The 85 <br /> day review period expired on April 24, 1987. The <br /> plat would have been considered by the Planning Board <br /> on April 20, 1987, but the meeting was postponed to <br /> April 27, 1987 due to a County holiday. <br /> Yuhasz expressed concern with the recommendation of <br /> payment- in-lieu if voluntary dedication is not <br /> possible. He indicated he felt that the effort <br /> should be made to obtain additional greenway noting <br /> that payment- in- lieu would not allow an opportunity <br /> for further greenway acquisition from subsequent <br /> owners. <br /> Jacobs noted that the words "per dwelling unit" <br /> should be deleted from the first sentence of <br /> condition 12. <br /> MOTION: Yuhasz moved approval deleting the last sentence of <br /> condition #2: " If voluntary dedication is not <br /> possible, . . . . ". Seconded by Taylor. <br /> VOTE: Unanimous. <br />
