( 1 .04 <br /> acres) would provide a 60-foot wide greenway adjacent to <br /> Prices Creek. Since slopes adjacent to the creek range from <br /> 15% to 25%, and the area is unbuildable due to stream buffer <br /> provisions, a voluntary dedication may be possible. The <br /> Recreation and Parks Director has requested an opportunity <br /> to pursue such a voluntary dedication for additional <br /> greenway. <br /> The N.C. Department of Transportation stated that their <br /> policy is to require all public and private roads that <br /> intersect with a State-maintained road at right angles. <br /> October Woods Road is a pre-existing Class B Private Road. <br /> A private road is justified as follows : <br /> 1 . The subdivision consists of less than ten ( 10) lots. Two <br /> (2) additional lots are being added to three (3) existing <br /> lots served by the private road for a total of five ( 5) <br /> lots. <br /> 2. The subdivision does not include or abut any part of a <br /> thoroughfare or street shown on the Orange County <br /> thoroughfare plan or the thoroughfare plan of an Orange <br /> County municipality. <br /> 3. The subdivision represents the division of a lot in a <br /> subdivision where streets are private or unpaved. <br /> October Woods Road is a Class B private road and unpaved. <br /> All lots would front on the existing private road. <br /> At its April 27 , 1987 meeting, the Planning Board <br /> recommended approval of the Preliminary Plan subject to the <br /> following conditions : <br /> ( 1 ) Show existing structure( s) on the plat. <br /> (2) Provide for dedication of recreation space ( greenway) <br /> equivalent to 3/20th of an acre of land (6, 534 sq. ft. ) <br /> and located adjacent to Prices Creek. Further <br /> recommend that the developer meet with the Recreation <br /> and Parks Director to discuss voluntary dedication of <br /> additional property adjacent to Prices Creek for <br /> additional greenway. <br /> (3) Show location of 100-year flood plain boundary adjacent <br /> to Prices Creek and provide notation, "Use of land <br /> within a floodway or floodway fringe is substantially <br /> restricted by the Orange County Flood Damage Prevention <br /> Ordinance. " <br /> (4) Calculate stream buffer as required by Article 6 .23 . 1 <br />
