U 7 L` 16 <br /> vote for would have planning jurisdiction for the future of his <br /> community if the land swap takes place. <br /> Mr. George Woodgates stated he is a resident of Barrington Hills. <br /> He indicated that he was very suspicious of a move where Carrboro <br /> is going to take over the responsibility for an area such as the <br /> Calvander area. He indicated he felt this was just another move on <br /> Carrboro' s part to take over and annex an area with or without its <br /> consent. He stated he felt watershed protection was priority, and <br /> no expansion should be considered until such time as the study is <br /> completed. He presented a petition which stated the residents of <br /> Barrington Hills were strongly opposed to any plan to include <br /> Calvander as a part of Carrboro. <br /> Mr. Richard Ellington expressed opposition to the land swap. He <br /> had several questions concerning the proposed 13 point agreement. <br /> His first question regarded the study of resolution of positions. <br /> There was no time period specified for completion of that study. <br /> With no time period specified• residents of the transition area <br /> would be left "in limbo" . His second question was whether the <br /> County or Chapel Hill opposed extraterritorial jurisdiction for <br /> Carrboro in the University Lake Watershed when it was established. <br /> ,Shirley Marshall, Chair of the Board of Commissioners , responded <br /> in answer to the first question that at the end of the public <br /> hearing the topics discussed would be referred to the Orange County <br /> Planning Board for their recommendation. The Orange County Board <br /> of Commissioners would receive that recommendation at the April 6 <br /> meeting. In response to the second question. she indicated that <br /> the extraterritorial jurisdiction for Chapel Hill and Carrboro was <br /> a remnant of times when the County did not have enabling <br /> legislation. At that time. only cities could plan. zone. and <br /> enforce building codes. Cities were granted extraterritorial <br /> jurisdiction for first up to one mile and then up to three miles <br /> from their city limits for these functions. After the County was <br /> given enabling legislation for comprehensive planning. subdivision <br /> regulation and building code enforcement. the County did not have <br /> to give extraterritorial jurisdiction. Some ten years ago. <br /> additional extraterritorial jurisdiction was requested and the <br /> citizens of the County said no. This was the time when joint <br /> planning was initiated. <br /> . added that the rectangular <br /> boundary around Chapel Hill and Carrboro except as distorted by <br /> annexation is the result of an act of the General Assembly. It was <br /> established before the County was in the business of planning. <br /> Don Willhoitj Commissioner , said that it was initially designated <br /> in the 1950 's and was set aside as Chapel Hill area. It was <br /> subsequently split into Chapel Hill and Carrboro. The issue of <br /> watershed protection initially arose in 1971. <br /> Mr._ Ellington continued by expressing his concern not only for the <br /> proposed Amberly Subdivision but also Laurel Springs and <br />
