1 . road , including rights-of-way acquisition and <br /> construction of ancillary facilities; 2. open space <br /> and recreation; 3 . publicly assisted housing ; 4 . <br /> public elementary and secondary school capital outlay, <br /> including retirement of indebtedness incurred by the <br /> county for this purpose; and 5. other public buildings. <br /> Any municipality in the county may, by Resolution, elect to <br /> not receive its distributive share of the tax imposed herein by <br /> delivering the Resolution so electing to the Clerk to the Board <br /> of County Commissioners on or before June 30. All such elections <br /> shall be made annually. Any such election shall be for the tax <br /> collected for instruments recorded for the year beginning July 1 <br /> following the election. In the event one or more municipalities <br /> elects not to receive its distributive share, the net _proceeds of <br /> the tax collected for the year shall be distributed to the county <br /> and the remaining municipalities according to the method herein <br /> prescribed after eliminating from the calculation the effect on <br /> it of the so electing municipalities. <br /> (f) Per Capita method defined. The net proceeds of the tax <br /> collected in the County shall be divided between the county and <br /> municipalities therein upon a per capita basis according to the <br /> total population of the county, plus the total population of the <br /> municipalities therein ; _provided , however , that " total <br /> o ulation" of a munici alit 1 in within more than one count <br /> shall be onl that art of its o ulation which lies within the <br /> taxing county. For this purpose, the County Finance Director <br /> shall determine a per capita figure by dividing the net proceeds <br />
