2 144 <br /> With regards to condition 1 , the location of Eno River <br /> Estates is a significant consideration . The only access to <br /> the property is via the private road that crosses the Eno <br /> River on the existing bridge Just below Lake Orange dam. <br /> State maintenance on SR 1323 ends approximately 875 feet <br /> east of the property that will be subdivided to create Eno <br /> River Estates. This means. that there can be no further use <br /> made of the roads without the consent of those persons who <br /> hold the private road easement. This and the location of the <br /> subdivision indicate little Ilkelihood. that the roads in Eno <br /> River Estates will be extended significantly. <br /> With regards to condition 2, three of the five condi- <br /> tions that Justify private roads exist with Eno River <br /> Estates. The subdivision does not include or abut a street <br /> designated in a thoroughfare plan nor is it in a designated <br /> transition area. Access to the subdivision will be thorough <br /> extension of an existing private road. NCDOT would not <br /> accept the subdivision roads for maintenance until the bridge <br /> meets State standards. While the bridge appears to be <br /> adequate, extensive changes would be needed to bring the <br /> bridge up to State standards. The bridge is not located on <br /> the property to be subdivided, so the County cannot require <br /> bridge improvements as part of subdivision approval . <br /> Therefore, even if built to State standards, the State would <br /> not accept the subdivision roads for maintenance because of <br /> the bridge. <br /> RECOMMENDATIONS <br /> 1 . The subdivision roads in Eno River Estates should <br /> be built to State standards, but be privately <br /> maintained. <br /> 2. The Road Maintenance Agreement for the private <br /> roads in Eno River Estates should indicate that the <br /> roads will be maintained to State standards. <br /> 3. The community association that will maintain the <br /> private roads in the subdivision should establish a <br /> _ capital fund that will be sufficient to replace, in <br /> compliance with NCDOT guidelines (minimum construc- <br /> tion standards for bridges) , the bridge crossing <br /> the Eno River. Capitalization of the fund should <br /> be determined by a qualified engineer and should be <br /> based on the estimated replacement cost being <br /> available at the end of the bridge' s remaining life <br /> span. <br />
