144 , <br /> SUBJECT: Eno River Estates - Preliminary Plan <br /> Private Road Evaluation <br /> BACKGROUND. <br /> Private roads may be allowed in a subdivision when the <br /> following conditions have been found to exist. <br /> 1 . The nature and location of the subdivision, includh <br /> ing such considerations as topography, the <br /> surrounding area, present and future road plans, <br /> and public safety access Justify private roads, and <br /> 2. One or more of the following conditions exist: <br /> a) the subdivision consists of less than ten ( 10) <br /> lots; <br /> b) the subdivision preserves a natural area <br /> through deed restriction and special design <br /> features; <br /> c) the subdivision does not include or abut any <br /> part of a thoroughfare or street shown on the <br /> Orange County thoroughfare plan or the <br /> thoroughfare plan of an Orange County munici- <br /> pal ity, or does not lie within a designated <br /> transition area determined by the County; <br /> d) the subdivision Joins or extends an existing <br /> subdivision where the streets are private or <br /> unpaved and when the new subdivision shall be <br /> platted to connect with the streets of such <br /> existing subdivision and be compatible with <br /> and in harmony with the surrounding community <br /> area; <br /> e) the subdivision roads, even if constructed to <br /> State Standards, would not be accepted by the <br /> State for maintenance due to density or some <br /> other State requirements that the subdivision <br /> cannot meet. <br /> EVALUATION <br /> In applying these conditions to Eno River Estates, the <br /> Planning Staff notes that the owner intends to build the <br /> roads in the subdivision to NCDOT standards, but intends to <br /> retain ownership and maintain them as private roads. The <br /> reason for this is to avoid rebuilding the Eno River bridge <br /> to NCDOT standards. The bridge must be considered as a <br /> significant factor in applying the conditions that allow <br /> private roads. <br />
