009 <br /> GENERAL ASSEMBLY OF NORTH CAROLINA SESSION 1987 <br /> 1 Whereas, local governing bodies and private nonprofit agencies have <br /> 2 made substantial progress in providing cost-effective transportation services to the <br /> 3 elderly and the handicapped; and <br /> 4 Whereas, the General Assembly finds that there is a need for State funds <br /> 5 with which to supplement existing sources of support for transportation services for <br /> 6 the elderly and the handicapped, but not to replace funds already earmarked for this <br /> 7 purpose by local governments; and <br /> 8 Whereas, this additional funding for transportation services for the elderly <br /> 9 and the handicapped has the potential to delay or preclude the placement of <br /> 10 individuals in rest homes or nursing homes, to improve the quality of life of elderly <br /> 11 and handicapped citizens, to provide opportunity for employment training programs <br /> 12 for the handicapped, and to reinforce the coordination of transportation resources <br /> 13 and strengthen the present planning process; Now, therefore, <br /> 14 The General Assembly of North Carolina enacts: <br /> 15 Section 1. Article 2B of Chapter 136 is amended by adding a new <br /> 16 section to read: <br /> 17 "§ 136-44.27. North Carolina Elderly and Handicapped Transportation Assistance <br /> 18 Program.--(a) There is established the Elderly and Handicapped. Transportation <br /> 19 Assistance Program that shall provide State financed elderly and handicapped <br /> 20 transportation services for counties within the State. The Department of <br /> 21 Transportation is designated as the agency of the State responsible for administering <br /> 22 State funds appropriated to purchase elderly and handicapped transportation services <br /> 23 for counties within the State. The Department shall develop appropriate procedures <br /> 24 regarding the distribution and use of these funds and shall adopt rules to implement <br /> 25 these procedures. No funds appropriated pursuant to this act may be used to cover <br /> 26 State administration costs. <br /> 27 (b) For the purposes of this section, an elderly person is defined as one who has <br /> 28 reached the age of 60 or more years, and a handicapped person is defined as one who <br /> 29 has a physical or mental impairment that substantially limits one or more major life <br /> 30 activities, an individual who has a record of such impairment, or an individual who is <br /> 31 regarded as having such an impairment. Certification of eligibility shall be the <br /> 32 responsibility of the county. <br /> 33 (c) All funds distributed by the Department under this section are intended to <br /> 34 purchase additional transportation services, not to replace funds now being used by <br /> 35 local governments for that purpose.
