(Public) <br /> Sponsors: Representatives Hackney; Holt, Colton, Fletcher, Barnes, Bruce <br /> Ethridge, Easterling, Buchanan. <br /> Referred to: Judiciary III. <br /> February 25, 1987 <br /> 1 A BILL TO BE ENTITLED <br /> 2 AN ACT TO REQUIRE A BOND OR OTHER COLLATERAL AS A <br /> 3 CONDITION TO ISSUE A PERMIT FOR THE OPERATION OF TREATMENT <br /> 4 WORKS. <br /> 5 The General Assembly of North Carolina enacts: <br /> 6 Section 1. G.S. 143-215.1 is amended by inserting a new subsection to <br /> 7 read: <br /> 8 "(d2) Bond or other Collateral Required. This subsection applies only to <br /> 9 applicants, other than a unit of State or local government, who apply for a permit or <br /> 10 renewal of a permit under subsection(c) or (d) to operate treatment works serving <br /> 11 three or more units used for residential purposes; two or more units used as offices or <br /> 12 for business, industrial, or commercial purposes; or two or more units used for a <br /> 13 combination of the above purposes. <br /> 14 The Commission may not issue or renew a permit under subsection (c) or (d) <br /> 15 unless the applicant has filed a bond, other collateral, or a written agreement <br /> 16 approved by the Commission, as required below. An applicant shall furnish a bond <br /> 17 in an amount of not less than ten thousand dollars ($10,000) nor more than two <br /> ' 18 hundred thousand dollars ($200,000). <br />
