UNC Chapel Hill Permit <br /> L. DISPUTE RESOLUTION <br /> Notwithstanding any other provisions in this permit, in the event the Permittee disagrees, in whole <br /> or in part, with the Department's revision of a submittal or disapproval of any revised submittal <br /> required by the permit, the following may, at the Permittee's discretion, apply: <br /> 1. In the event that the Permittee chooses to invoke the provisions of this section, the Permittee <br /> shall notify the Department in writing within thirty(30) days of receipt of the Department's <br /> revision of a submittal or disapproval of a revised submittal. Such notice shall set forth the <br /> specific matters in dispute, the position the Permittee asserts should be adopted as consistent <br /> with the requirements of the permit, the basis for the Permittee's position, and any matters <br /> considered necessary for the Department's determination. <br /> 2. The Department and the Permittee shall have an additional thirty(30) days from the <br /> Department's receipt of the notification provided for in Condition I.L.1. to meet or confer to <br /> resolve any disagreement. <br /> 3. In the event an agreement is reached, the Permittee shall submit the revised submittal and <br /> implement the same in accordance with and within the time frame specified in such <br /> agreement. <br /> 4. If agreement is not reached within the thirty(30) day period, the Department will notify the <br /> Permittee in writing of his/her decision on the dispute, and the Permittee shall comply with <br /> the terms and conditions of the Department's decision in the dispute. For the purposes of this <br /> provision in this permit, the responsibility for making this decision shall not be delegated <br /> below the Chief of the Hazardous Waste Section. <br /> Invoking any of the dispute resolution procedures of this section does not preclude the <br /> Permittee from exercising any of its other rights to petition for a contested case hearing or <br /> appeal in accordance with N.C. General Statute 150B. Nor does invoking any of the dispute <br /> resolution procedures of this section extend or delay the time periods in which the Permittee <br /> must exercise any of those other rights to petition or appeal. <br /> 5. With the exception of those conditions under dispute, the Permittee shall proceed to take any <br /> action required by those portions of the submission and of the permit that the Department <br /> determines are not affected by the dispute. <br /> M.
