UNC Chapel Hill Permit <br /> 2. Pursuant to 40 CFR 270.41 as adopted in 15A NCAC 13A .0113, a permit modification will <br /> be initiated by the Department upon concurrence of a remedy selected in accordance with <br /> Condition IV.I.1. This modification will serve to incorporate a final remedy into the permit. <br /> 3. Within one hundred and twenty(120) calendar days after this Permit has been modified, the <br /> Permittee shall demonstrate financial assurance for completing the approved remedy. <br /> J. MODIFICATION OF THE CORRECTIVE ACTION SCHEDULE OF COMPLIANCE <br /> 1. If at any time the Department determines that modification of the Corrective Action Schedule <br /> of Compliance is necessary, the Department may initiate a modification to the Schedule of <br /> Compliance, Appendix E. <br /> 2. Modifications that are initiated and finalized by the Department will be in accordance with <br /> the applicable provisions of 40 CFR 270 as adopted in 15A NCAC 13A .0113. The <br /> Permittee may also request a permit modification in accordance with 40 CFR 270 as adopted <br /> in 15A NCAC 13A .0113. <br /> K. IMMINENT HAZARDS <br /> 1. The Permittee shall report to the Department any imminent or existing hazard to public health <br /> or the environment from any release of hazardous waste or hazardous constituents. Such <br /> information shall be reported orally within 24 hours from such time the Permittee becomes <br /> aware of the circumstances. This report shall include the information specified under <br /> Condition I.D.14. <br /> 2. A written report shall also be provided to the Department within fifteen (15) calendar days of <br /> the time the Permittee becomes aware of the circumstances. The written report shall contain <br /> the information specified under Condition I.D.14. and; a description of the release and its <br /> cause; the period of the release; whether the release has been stopped; and if not, the <br /> anticipated time it is expected to continue; and steps taken or planned to reduce, eliminate, <br /> and prevent recurrence of the release. <br /> L. WORKPLAN AND REPORT REQUIREMENTS <br /> 1. All plans and schedules shall be subject to approval by the Department prior to <br /> implementation to assure that such workplans and schedules are consistent with the <br /> requirements of this permit and with applicable regulations and guidance. The Permittee <br /> shall revise all submittals and schedules as specified by the Department. Upon approval the <br /> Permittee shall implement all plans and schedules as written. <br /> 2. The results of all plans and reports shall be submitted in accordance with the approved <br /> schedule. Extensions of the due date for submittals may be granted by the Department based <br /> on the Permittee's demonstration that sufficient justification for the extension exists. <br /> IV-12 <br />
