UNC Chapel Hill Permit <br /> PART IV- CORRECTIVE ACTION FOR SOLID WASTE MANAGEMENT UNITS (SWMUs) <br /> and AREAS OF CONCERN (ADCs) <br /> The purpose of this section is to provide the facility direction to: <br /> 1) Perform a RCRA Facility Investigation to determine fully the nature and extent of any release of <br /> hazardous waste and/or hazardous constituents at or from the Facility; <br /> 2) Perform a Corrective Measures Study to identify and evaluate alternatives for the corrective <br /> measures necessary to prevent, mitigate, and/or remediate any releases of hazardous wastes or <br /> hazardous constituents at or from the Facility; <br /> 3) Implement the corrective measure or measures selected by the Facility and approved by the State; <br /> and <br /> 4) Perform any other activities necessary to correct or evaluate actual or potential threats to human <br /> health and/or the environment resulting from the release or potential release of hazardous waste or <br /> hazardous constituents at or from the Facility. <br /> It is understood that some of the information that is required in this Section has either been <br /> submitted or is in process. <br /> A. APPLICABILITY <br /> The Conditions of this Part apply to: <br /> 1. The solid waste management units (SWMUs) and areas of concern(ADCs) identified in <br /> Appendix A of the permit, which require a RCRA Facility Investigation (RFI). There are no <br /> SWMUs or AOCs which require an RFI at this time. <br /> 2. The SWMUs and AOCs identified in Appendix A which require no further investigation at <br /> this time or are addressed under the permit. <br /> 3. The SWMUs and AOCs identified in Appendix A which require confirmatory sampling. <br /> There are no SWMUs or AOCs which require confirmatory sampling at this time. <br /> 4. Any additional SWMUs or AOCs discovered during the course of ground-water monitoring, <br /> field investigations, environmental audits, or other means. <br /> 5. Contamination beyond the facility boundary, if necessary. The Permittee shall implement <br /> corrective actions beyond the facility boundary where necessary to protect human health and <br /> the environment, unless the Permittee demonstrates to the satisfaction of the Department that, <br /> despite the Permittee's best efforts, as determined by the Department, the Permittee was <br /> unable to obtain the necessary permission to undertake such actions. The Permittee is not <br /> relieved of all responsibility to clean up a release that has migrated beyond the facility <br /> boundary where off-site access is denied. On-site measures to address such releases will be <br /> determined on a case-by-case basis. Assurances of financial responsibility for completion of <br /> such off-site corrective action will be required. <br /> Iv-1 <br />
