It is further my <br /> recommendation that the Board authorize the Chair to <br /> execute this letter and to have it delivered to Mr. <br /> Nichols at his home on March 25, 1987. It is my <br /> opinion that the offer to sell the land is just that <br /> and is not in satisfaction of the obligation of Lake <br /> Orange pursuant to the right of first refusal contained <br /> in the deed from Lake Orange to the County. <br /> This action is, of course, only a "holding" one. <br /> The problem of who owns, and subject to what, the land <br /> 'd surrounding Lake Orange between elevations 615 to 620 <br /> feet is not resolved by refusing Lake Orange's offer to <br /> sell a portion of this land and by Orange County <br /> reserving its rights under the deed from Lake Orange, <br /> Inc. <br /> I Apparently, and unfortunately, Lake Orange, Inc. <br /> is not prepared to go forward with an action to quiet <br /> title on this property. Our search of the title <br /> I; questions on behalf of Lake Orange at the time it was <br /> done, revealed only two deeds which purported to convey <br /> title to persons to the area in question. However, <br /> there are other deeds which "quitclaim" portions of the <br /> property in question and there are recorded plats of <br />
