33 <br /> RURAL BUFFER IMPLEMENTATION TECHNIQUES <br /> MEASURES USED BY OTHER JURISDICTIONS <br /> Impact Zgnina <br /> Definition <br /> Also known as performance zoning. development impact <br /> zoning. or land capacity zoning. <br /> This technique establishes performance standards and <br /> methods for evaluating the impact of land use proposals. It <br /> establishes a framework for negotiation between a developer <br /> and a local government for the purpose of generating a <br /> proposal that produces no overall negative or damaging <br /> impacts on the community. It has four primary characteris- <br /> tics: <br /> 1. It relates land use demands to land use capacities. <br /> 2. It assesses the consequences of any proposed change <br /> in land use. <br /> 3. It emphasizes an on-going process rather than fixed <br /> products. <br /> 4. It provides a legislative and administrative <br /> framework for land use management and uses minimal <br /> land use controls. <br /> The intent of impact zoning is to replace traditional <br /> use specifications with a broad set of objective standards. <br /> These standards may be as simple as a requirement that total <br /> tax revenues from the development offset the cost of public <br /> services for the development. or they may involve complex <br /> formulas for matters such as peak hour stormwater runoff <br /> performance calculations. All such measures are set out in <br /> the ordinance so that they can and will be used. <br /> Application <br /> Impact zoning can be used as part of a conventional <br /> zoning ordinance or can be offered as an alternative to <br /> conventional zoning. Before it can be used it is necessary <br /> to develop an impact measurement system. In achieving this. <br /> it is necessary to incorporate impact measurement into the <br /> planning program. As part of the planning program. it may be <br /> possible to not only develop impact measurements. but also <br /> make the public more familiar with the concept. An innova- <br /> tive technique such as impact zoning may cause uncertainty <br /> among land owners as to what type of development it will <br /> permit and the subsequent affect on land values. <br />
