15 <br /> RURAL BUFFER IMPLEMENTATION MEASURE <br /> Recreation Reguirements <br /> Dessrigtion <br /> The Orange County Subdivision Ordinance requires the <br /> provision of public recreation and/or open space by every <br /> major subdivision in the Joint Land Use Planning Area. The <br /> purpose of this requirement. is to provide for the Leisure <br /> needs of the subdivision residents and/or to preserve signi- <br /> ficant natural features and cultural resources. <br /> In residential subdivisions, the amount of Land that <br /> must be dedicated to recreation and/or open space is deter- <br /> mined by the number of dwelling units in the subdivision. At <br /> least one thirty fifth (1 /35) of an acre must be dedicated <br /> for each dwelling unit . If the land in the subdivision is <br /> located in a designated flood plain or is characterized by <br /> steep slopes (15% or greater) , then one twentieth (1/20) of <br /> an acre must be dedicated for each dwelling unit: The <br /> location of the land to be dedicated will be recommended by <br /> the County Recreation and Parks Advisory Council. The <br /> location will include areas designated in the Land Use Plan <br /> for recreation and/or open space and areas suitabLe for such <br /> use. <br /> In non-residential subdivisions, the amount of Land to <br /> be dedicated will be determined by a site analysis, the <br /> proposed uses, and the location of areas designated in the <br /> Land Use Plan for recreation and/or open space. As a mini- <br /> mum, the amount of land dedicated wilt equal the area that <br /> would be required by the Pedestrian/Landscape ratio in the <br /> Land Use Intensity System contained in the Orange County <br /> Zoning Ordinance. <br /> An option exists for subdivisions Located where no Land <br /> has been designated in the Land Use Plan for recreation <br /> and/or open spaces. In such cases, instead of dedicating <br /> land for recreation and/or open space, the subdivider may, <br /> with the approval of the Board of Commissioners, make a <br /> payment-in-lieu of dedication or a combination of Land <br /> dedication and payment. When such a payment has been <br /> approved the amount of the payment wiLL be based on the <br /> number of acres that would have been dedicated and the <br /> current assessed value of the land. <br /> Application <br /> Application of this requirement is Limited to portions <br /> of Orange County where recreation plans have been adopted. <br /> At present, the Joint Land Use Planning Area is the only such <br /> area. Since its adoption, this requirement has been applied <br /> to several major subdivisions in the Joint Planning.
