The <br /> policy that would be established by the decision would <br /> also apply to five (5) other minor subdivision <br /> applications that were in process when the Rural Buffer <br /> standards went into effect. Approval of these <br /> subdivisions would allow eight (8) lots less than two <br /> (2) acres in size to be created in the Rural Buffer. <br /> The approval process for minor subdivisions consists of <br /> sketch plan review, final plat review, and final plat <br /> approval. A sketch plan is submitted showing the <br /> general layout of the proposed subdivision. The <br /> Planning Staff reviews the sketch to determine general <br /> compliance with relevant ordinances, codes, and <br /> policies and the general suitability of the land for <br /> development. Staff comments are conveyed to the <br /> property owner immediately after review. The property <br /> owner then submits a final plat that incorporates staff <br /> comments. The staff reviews the final plat and upon <br /> satisfaction of all requirements approves the plat. <br /> While the staff approves most minor subdivision final <br /> plats, the Planning Board has final approval authority. <br /> Since this involves establishing a policy for <br /> implementing a County ordinance, Planning Board action <br /> will be to make a recommendation to the Board of <br /> Commissioners. <br /> The Planning Staff recommends the following policy: <br /> minor subdivision applications for the division of <br /> land in the Rural Buffer that contain lots that <br /> are less than two (2) acres in size may be <br /> approved by the Planning Department, if: <br /> 1. the minor subdivision approval process began <br /> before the date the Rural Buffer standards <br /> went into effect; <br /> 2. the applicant can demonstrate efforts to <br /> proceed with the subdivision based on staff <br /> comments indicating that one U Y acre lots <br /> were permiss able; <br /> 3. that only lots indicated on a ' previously <br /> submitted sketch plan or final plat as being <br /> less than two (2) acres in size may be <br /> approved as such; and <br /> 4. lots less than two (2) acres in size must <br /> conform to applicable AR or R-1 zoning <br /> requirements that were in effect when the <br /> application was submitted. <br /> Should this policy be adopted, the Planning Staff <br /> recommends that the review of Ms. Ellison Gilland' s <br /> minor subdivision application be conducted using the <br />
