AGENDA ITEM #8c: Policy-Application of Rural Buffer <br /> Standards to Minor Subdivisions <br /> Presentation by Greg Szymik. <br /> This agenda item is to recommend a policy for applying <br /> Rural Buffer standards to minor subdivision <br /> applications that were in process when the new <br /> standards went into effect. <br /> Also, to determine applicability of Rural Buffer <br /> standards to a minor subdivision application by Ellison <br /> Gilland. <br /> On August 51 1986 when the revised Joint Land Use Plan <br /> was adopted creating a two (2) acre lot size <br /> requirement in the Rural Buffer, a number of minor <br /> subdivision applications for land located in the Rural <br /> Buffer were in process. These included a minor <br /> subdivision application submitted by Ellison Gilland <br /> for property located at map reference 7.16. .6C. She <br /> has requested a policy decision regarding whether the <br /> Rural Buffer standards should apply to the proposed <br /> division of her two (2) acre tract into two (2) one (1) <br /> acre tracts. <br /> This policyr once determined could be applied to other <br /> minor subdivision applications that were in process <br /> when the new Rural Buffer standards went into effect. <br /> Ms. Gilland submitted a sketch plan for a minor <br /> subdivision of her property on 12/10/85. Staff review <br /> indicated that since she had a single family residence <br /> and a mobile home on a parcel zoned for single family <br /> residential use (R-1) y that her property was a non <br /> conforming use and that the subdivision could not be <br /> approved unless the mobile home was removed. Ms. <br /> Gilland submitted a revised sketch plan on 7/23/86. <br /> This sketch indicated that the mobile home-, would be <br /> removed and its septic system abandoned. Staff <br /> comments were conveyed to Ms. Gilland on 7/24/86. The <br /> proposed subdivision appeared to be consistent with the <br /> ordinances. Ms. Gilland indicated that she was leaving <br /> for England and would pursue the subdivision on her <br /> return. The new Rural Buffer standards were adopted <br /> 8/5/86. Upon returning from England in December, Ms. <br /> Gilland learned of the change. When told it would <br /> prevent her subdivision, she asked for a policy <br /> decision regarding application of the Rural Buffer <br /> standards to her application.. <br /> The impact of this decision will be to allow or not <br />
