A "lot of <br /> record" is a lot created by deed or plat <br /> prior to the existence of or amendment to <br /> zoning regulations applicable to the lot. <br /> IMPACTS/ISSUES: On January 5, 1987. the Board of Commissioners <br /> enacted provisions creating a Rural Buffer (RB) <br /> zoning district and establishing a two-acre <br /> minimum lot size requirement therein. The <br /> provisions were applied to 38,000 acres of land <br /> surrounding the Chapel Hill-Carrboro area. <br /> Data from the Orange County Land Records Office <br /> indicates that 244 lots (5.7% of all lots) in <br /> the Rural Buffer are less than two acres in <br /> size, in the same ownership and of continuous <br /> frontage. The lots would have to be combined to <br /> meet the minimum lot size standard of two acres. <br /> 142 (3.3% Of all lots) of the lots are <br /> developed. <br /> The Board of Commissioners placed a moratorium <br /> on enforcement of Article 11.7, pending a public <br /> hearing to consider revisions to or deletion of <br /> the provisions. Any amendment would be <br /> applicable in all zoned townships. <br /> Approval of the amendment would permit <br /> construction of single-family dwellings on 102 <br /> lots (2.4% of all lots) in the Rural Buffer <br /> district. Historically, sibdivision activity <br /> has been greater in Chapel Hill Township. <br /> Application of the amendment to all zoned <br /> townships would affect a smaller proportion of <br /> lots. <br /> Chapel Hill, Carrboro, Forsyth County, and <br /> Mecklenburg County require the combination of <br /> nonconforming lots to meet ordinance standards. <br />
