Mr. Marvin Collins Page Two _ Octc beer 3, 1986. <br /> Joint Planning Area Land Use Plan which requires a . <br /> minimum of 2 acres per unit in the rural buffer area.. <br /> First of all, lots of record and nonconforming lots are <br /> specifically addressed in the Zoning Ordinance and <br /> should be treated accordingly. Any proposed <br /> development which has not received either preliminary I <br /> plan approval, in' the case of a subdivision request, or <br /> has not been granted a special use permit, in the case <br /> of a planned development, must, I think, meet the 2 <br /> acre minimum lot size requirement. <br /> Section III-B-1 of the subdivision regulations <br /> requires the planning department to review a <br /> subdivision sketch design plan for "compatibility with <br /> the comprehensive plan for the County." Section IV, <br /> entitled "REQUIRED MINIMUM DESIGN STANDARDS,' recites <br /> the policy of subdivision regulations, that is, "the <br /> avoidance of congestion and overcrowding and the <br /> creation of conditions essential to public health, <br /> safety and the general welfare," and then goes on to <br /> state that these goals are to be accomplished through <br /> the application of design standards "providing for the <br /> distribution of population and traffic, safe and <br /> coordinated street systems, approved water supply and <br /> sewage disposal systems, useable lots and conformance <br /> to plans for Orange County. . .adopted by the Board of <br /> Commissioners. " (Emphasis added.) Subsection B-1 of <br /> Section IV requires lots served by on site sewage <br /> disposal and water systems to be at least 40,000 square <br /> feet and lots served by public or community water and <br /> sewer to comply with the appropriate zoning ordinance. <br /> These requirements are minimum lot size requirements. <br /> The idea that the lot size requirements are minimums is <br /> further underscored by the need to meet watershed <br /> protection standards regardless of the lot size <br /> necessary to accomplish those standards. <br /> The Zoning Ordinance permits the development of. <br /> planned development districts. Section 7.1 of the <br /> Zoning Ordinance provides, in the first paragraph, that <br /> planned development districts may be established where <br /> "suitability of [land] for the development proposed <br /> shall be determined primarily by reference to the <br /> comprehensive plane-"-=-.The PD analysis may also give <br /> "due consideration to the existing and perspective <br /> character of surrounding development. " Furthermore, <br /> the last paragraph of Section 7.1 states that PD <br /> districts "are intended to accomplish the purposes of <br /> zoning and other applicable regulations to an <br /> equivalent or higher degree than where such regulations <br /> are intended to control unscheduled development on <br />
