The Executive Committee shall consist <br /> of the Chair, the first Vice-Chair, the Second Vice-Chair, the <br /> immediate past Chair (who must be a current member) , and the <br /> Coordinator, who shall serve as a non-voting, ex-officio <br /> member. The Executive Committee shall have the authority to <br /> Should a tie vote occur, the issue shall be brought <br /> before the entire Commission. All business . . . . " <br /> Motion was made by Commissioner Carey, seconded by Commissioner <br /> Halkiotis to approve items 1 and 3 of the Consent Agenda. <br /> VOTE: UNANIMOUS. <br /> 2 . ANIMAL SHELTER CHANGE ORDER <br /> After discussion by the Board the Animal Shelter change order was <br /> deleted. The work will be performed by the County maintenance personnel <br /> after completion of contract. <br /> F. ITEMS FOR DECISION - REGULAR AGENDA <br /> 1. ZONING ORDINANCE TEXT/ATLAS AMENDMENT -- RURAL BUFFER <br /> PRESENTATION <br /> Director of Planning Marvin Collins presented a petition from Mr. <br /> Whitfield which will become a part of the permanent agenda file in the <br /> Clerk's office. <br /> Collins presented the proposed revisions to the Zoning Ordinance <br /> text and atlas which would establish a new zoning district classification, <br /> Rural Buffer (RB) ; establish criteria for its application; set interim <br /> dimensional requirements for lot area and rezone approximately 38, 000 <br /> acres from Rural Residential (R-1) and Agricultural Residential (AR) to <br /> Rural Buffer (RB) . <br /> The Planning Board recommended that no action be taken at this <br /> time on the RB proposals and that a public hearing be held on March 10, <br /> 1987 jointly with the Town of Chapel Hill. <br /> The County Attorney recommended against delaying the adoption of <br /> the proposed amendments because of the strong relationship between the <br /> Land Use Plan and the Zoning Ordinance. He recommended against leaving <br /> all lots less than two acres in their present R-1 zoning classification <br /> because of prohibitions against "spot zoning. " He suggested that the <br /> "combination" issue be handled through an amendment to Article 11.7.2 of <br /> the Zoning Ordinance. <br /> BOARD COMMENTS AND/OR QUESTIONS_ <br /> In answer to a question from Commissioner Hartwell, Collins <br /> explained that a Commercial Feeder Operation would be an operation where a <br /> person has livestock available on site, provides feed on site and raises <br /> them for sale/resale. <br /> Commissioner Halkiotis questioned the urgency of voting on this <br /> item at this time instead of waiting until after the public hearing. <br /> County Attorney Geoffrey Gledhill explained that Orange County has a <br /> comprehensive plan which is regulated by the Zoning Ordinance and <br /> Subdivision Regulations. If one is changed the other must be changed to <br /> conform. In this way the actions by the Board are more defensible and <br /> less arbitrary in a court of law. <br /> Gledhill stated that the County has approved the minimum lot size <br /> of two acres in the RB district on its Comprehensive Plan and any delay in <br /> conforming the ordinances to the Comprehensive Plan puts that decision at <br />
