112 <br /> ORANGE COUNTY PLANNING DEPARTMENT <br /> MLLSBOROUGH <br /> NORTH CAROLINA <br /> 27278 <br /> 4,001 <br /> 4t,P../l <br /> MEMORANDUM <br /> TO: Orange County Planning Board <br /> FROM: Orange County Planning Staff <br /> DATE: December 9. 1986 <br /> SUBJECT: Stacy Heights Subdivision <br /> On September 26. 1986 the Orange County Planning Department <br /> received an application from George Tate. Jr. for preliminary <br /> plan approval of a major subdivision. The subdivision. Stacy <br /> Heights. is proposed on parcel 7.23.D. 25B. It is a 6.787 <br /> acre tract located on the east side of Rogers Road. The <br /> proposed subdivision would contain seven (7) lots. <br /> The parcel is located in the 10 year transition area desig- <br /> nated in the Orange County Land Use Plan. In accordance with <br /> the Joint Planning Agreement. the application was con- <br /> currently submitted to both Chapel Hill and Orange County <br /> Planning Departments. On December 2. 1986, Chapel Hill <br /> Planning Board recommended denial of Stacy Heights subdivi- <br /> sion. On December 8. 1986, Chapel Hill Town Council adopted <br /> a resolution recommending that the Orange County Commis- <br /> sioners deny the application. A copy of the recommended <br /> resolution is attached. It contains the reasons for the <br /> recommendation. <br /> Under the terms of the Joint Planning Agreement. the Orange <br /> County Planning Board cannot recommend approval of an appli- <br /> cation when Town Council recommends denial. Under the terms <br /> of Section III-D-1 of the Orange County Subdivision <br /> Ordinance, the Orange County Planning Board must act on an <br /> application within 85 days of receipt or it will automati- <br /> cally be deemed approved.
