It should be <br /> changed to 7.23.D.25B. <br /> (2) Although the property is in a Transition area. <br /> public sewer is not available. The nearest sewer <br /> is at Chapel Hill High School approximately 3500 <br /> feet to the south. Public water is also not <br /> available. Is approximately 2500 feet to the <br /> southeast. Since both water and sewer are <br /> expected to be available in the future. easements <br /> for their installation should be included on the <br /> plan. <br /> (3) A payment-in-lieu of dedication of recreation <br /> and/or open space be approved per Recreation <br /> Department recommendation. This payment should <br /> be in the amount of 51.544. . <br /> (4) A Class "C" private road should be indicated on <br /> the typical cross-section. <br /> (5) A recorded 10'x70 ' sight triangle be provided and <br /> shown on the plan at the intersection of Rogers <br /> Road and East Tallyho Trail per NCDOT comment. <br /> (6) Lots 1 and 2 be restricted to a "shared driveway" <br /> access onto Rogers Road with notation on the plat <br /> stating same. <br /> (7) The names of adjacent property owners shown on <br /> the plan should be corrected. <br /> Specific Planning Staff concerns were not addressed by <br /> the applicant. <br /> The Planning Staff recommends denial of the Preliminary <br /> Plan and recommends submittal of a revised plan after <br /> consultation with Town and County Staffs. <br /> MOTION: Shanklin moved approval of staff recommendation. <br /> Seconded by Best. <br /> Yuhasz questioned the incorporation of Chapel Hill <br /> recommendations for Orange County approval or disappro- <br /> val. Szymik responded that the Joint Planning <br /> Agreement permit the Orange County Board of <br /> Commissioners to deny a subdivision when there is a <br /> Council recommendation of denial from Chapel Hill. <br /> Yuhasz continued that he had some concerns with the <br /> Chapel Hill recommendations and did not feel there were <br /> sufficient problems to recommend denial of the <br /> subdivision.
