041 project. Specifically, as improvements are completed in <br /> each phase, a corresponding amount of money may be <br /> released from the security instruments or the security <br /> instruments may be renegotiated based on the "yet to do" <br /> portion of the improvements. <br /> 16. That the development be built and operating according to <br /> the site plan and written narrative supplied by the <br /> developer and in compliance with the above conditions. <br /> 17 . That roads, parking areas, walkways, street signs, <br /> utilities, recreation facilities and sites, and <br /> landscaping be maintained as constructed. All such <br /> improvements and facilities shall further be maintained <br /> and operated in a safe manner. <br /> 18. That a revised site plan be submitted showing <br /> construction - of 120 townhouse units phased for <br /> construction in a sequence equivalent to that conatained <br /> in condition # 12. <br /> 19. That a left turn lane be constructed on Eubanks <br /> Road at its intersection with N.C. 86 in accordance <br /> with NCDOT specifications, with final plans approved <br /> by the County Manager and NCDOT prior to construction. <br /> 20. That a payment-in-lieu of recreation area in the amount <br /> of $10.702 be made at the time of final subdivision plan <br /> approval or within one year of approval of the <br /> preliminary plat, whichever comes first, and that <br /> 2.42 acres of private recreation area be provided <br /> on-site for use by townhouse residents. <br /> 21. That the continued validity and effectiveness of this <br /> approval is expressly conditioned upon compliance with <br /> or fulfillment of these conditions, and upon compliance <br /> with applicable provisions of the Orange County <br /> Zoning Ordinance and the Chapel Hill Development <br /> Ordinance and regulations thereunder. <br /> 22. That if any of the above conditions shall be held <br /> invalid or void, then this approval shall be void <br /> and of no effect. <br /> The Planning Board also recommends that the Commissioners <br /> contact NCDOT and request them to evaluate the speed <br /> limit on Eubanks Road and Northwood Drive and the <br /> possibility of installing a traffic light at the <br /> intersection of Eubanks Road and N.C. 86. <br /> Article 8.2.2 states that where a preponderance of <br /> evidence indicates compliance with the general <br /> standards, specific rules governing the specific <br /> use. and that the use complies with all required <br /> regulations and standards, the application must <br /> be approved unless it is found, in some specific <br /> manner that; <br /> 1. The use will not promote the public health, <br /> safety and general welfare if located where <br />
