039 The Joint Planning Area Land Use Plan indicates that the <br /> site as well as surrounding properties to the north and east <br /> are to be used for Office/Institutional purposes. <br /> Residential uses such as that proposed would be permitted. <br /> The present zoning of the property is Residential-1 (R-1) . <br /> The property is also subject to the Major Transportation <br /> Corridor (MTC) overlay zoning district standards. The <br /> applicant is requesting a planned development rezoning to <br /> Planned Development-Housing-Residential-8 (PD-H-R-8) . <br /> IMPACT: Rezoning of the property would allow the clustered develop- <br /> ment of the property for townhouses for sale. <br /> The applicant has submitted a memorandum indicating that he <br /> will reduce the number of units from 137 to 120. He has <br /> further indicated his willingness to provide a left turn <br /> lane on Eubanks Road at its intersection with N.G. 86. (See <br /> attached memorandum.) <br /> RECOMMENDATION: The Planning Board recommends that the Planned Development- <br /> Housing-Residential 8 (PD-H--R--8) rezoning be approved and <br /> the Special Use Permit be issued subject to the following <br /> conditions: <br /> 1. That the private loop road serving the development be <br /> constructed in compliance with NCDOT pavement standards <br /> as specified on page 7 of the NCDOT manual on Minimum <br /> Construction Standards for Subdivision Roads. The loop <br /> road shall be constructed to serve each phase prior to <br /> the occupancy of any unit in the phase. (The unpaved <br /> portion of the loop road is to be used as a construction <br /> entrance.) <br /> 2. That Eubanks Road be improved to 1/2 of a 47-foot cross <br /> section with curb. gutter and sidewalk with dedication <br /> of 1/2 of an 80-foot right-of-way. <br /> 3. That final plans for all proposed improvements to Eubanks <br /> Road be according to Town standards with corresponding <br /> right-of-way widths as required under the Town Design <br /> Manual and approved by the Town Manager, County Manager <br /> and NCDOT prior to issuance of a Special Use Permit and <br /> that final plans for construction of the loop road be <br /> approved by the County Manager and NCDOT prior to <br /> issuance of a Special Use Permit. <br /> 4. That the central recreation area include a picnic <br /> facility. The location and design of the tot lot shown <br /> on the site plan and the picnic facility shall be <br /> reviewed and approved by the Orange County and Town of <br /> Chapel Hill Recreation Advisory Commissions. Recreation <br /> facilities shall be handicapped accessible and include <br /> handicapped parking areas. <br /> 5. That additional plantings be provided between buildings. <br /> 6. That final utility plans be approved by OWASA. Duke <br />
