Margaret Lane <br /> Hillsborough, NC 27278 <br /> RE: Meeting of County Commissioners, December 1, 1986 <br /> Dear Mr. Thompson: ' <br /> I represent Mr. Benjamin Edkins, the owner and operator of Carolina <br /> Sport Art located on Homestead Road in Chapel Hill. At a previous <br /> meeting of the County Commissioners, direction was given to _the County <br /> Attorney to begin legal proceedings to eliminate a violation of the <br /> • zoning ordinance, that violation being Carolina Sport Art located on <br /> Homestead Road. It is my information that in 1976, the owners of this <br /> property obtained permission from the county to build this facility to <br /> train a team of gymnasts to compete in the Olympics. ' It was operated <br /> at that time by a non-profit corporation. At some point in its history <br /> the operation was taken over by a for-profit corporation. Mr. Edkins <br /> is now the owner and operator of a for-profit corporation doing <br /> • business in the facility. Having become aware of the requirement' that <br /> recreational facilities in residential areas must be operated by non- <br /> profit corporations and then only upon the granting of a special use <br /> permit, Mr. Edkins is now in the process of forming such a non-profit <br /> corporation and making application for the required special use permit. <br /> I am requesting that this matter be placed on the agenda for the <br /> December 1, 1986 meeting of the County Commissioners for purposes of <br /> . asking the County Commissioners to delay any legal action against <br /> Mr. Edkins until such time as the Board of Adjustment may have an <br /> . opportunity to review his application at its January 12, 1987 meeting. <br /> If you have questions concerning this matter, please feel free to <br /> call me.
