DRAFT PBM MINUTES <br /> 056 FACE 16 <br /> developer (Calvin Mellott) is "requesting approval <br /> of a preliminary plan the Mel-Oak Estates-Phase 4 <br /> to allow six lots, each ' approximately 40.000 <br /> square feet. The property is 1 ated in the (:_ Al <br /> Buffer which presently requires a two acre MI JM <br /> lot size. The developer is requesting the <br /> Planning Board to consider approval of the six-lot <br /> design since Mel-Oaks has been an --going <br /> [ <br /> subdivision. <br /> A second Mel-Oak Estates Phase 4 pl has bean <br /> prepared to comply with the tw. acre minim " lot <br /> size if the Planning Board d. s not approve the <br /> ' first request. The plan indicates, three lots, <br /> each being 2.00 acres in size. Both subdivisions <br /> propose to construct Mel Oaks Trail to State <br /> standards. <br /> 1 - <br /> The 6.3 acre' tract is' zoned R-1 and is located in <br /> the Uni versity Lake Watershed. It is designated <br /> Rural Buffer and Protected. Water . -d ' II in the <br /> Joint Planning Land Use Plan. <br /> Approval of the' request .uld allow the <br /> development of either three or six additional lots <br /> in the subdivision. This wtauld result in an <br /> additional 30 or 60 trips per day entering onto <br /> Jones Ferry Road, bringing the total trips pey day <br /> for Mel-Oak Phase II to either 117 or 7, <br /> depending on the plan approved. • <br /> The Planning Staff recommends approval of 'the <br /> three-lot design forV Mel-Oak Estates Phase 4 <br /> subject to the following conditions: <br /> (1) That lots 15 and/or 16 access to Mel-Oaks <br /> Trail. This will provide the minimum number of <br /> lots (4) that the Department of Transportation <br /> requires to receive access fr. , a cul-de-sac. <br /> (2) There are no recreation areas or greenways <br /> designated for the site in the Joint Planning <br /> Area Land Use Plan. Another condition of <br /> approval is submission of payment in-lieu at the <br /> time of the time of fit - 1 plan approval or <br /> within one year of preliminary approval <br /> whichever occurs first. The payment shall be <br /> equal to $372 and is based on the standard-of <br /> 1/35th (0.03) of an acre per unit x 3 dwelling <br /> units on lots = 0.09 acres x $4135/acre (1q87 <br /> valuation) . If the Planning Board elects to <br /> approve six lots, the payment-in-lieu would be <br /> twice that amount or $744. <br />
