018 <br /> portion of the CJDA as shown on Exhibit A, it shall forward <br /> copies of the application and plans to the Carrboro Planning <br /> Department for review In accordance with administratively <br /> established procedures . The Orange County Board of <br /> Commissioners may not vote to issue or deny the permit until <br /> it has received the written recommendations of the Carrboro <br /> Board of Aldermen (or other designated board or staff ) or <br /> until the expiration of forty--five (45) days after the <br /> Carrboro Planning Department has received the application , <br /> whichever occurs first . <br /> Section 2. 5 Enforcement Remedies . <br /> A. Permit revocation, if necessary and authorized by <br /> ordinance, shall be handled by the individual or board <br /> authorized to issue the original permit . <br /> B . Within those portions of the Joint Planning Area <br /> where the ordinances specified in Section 2. 1 B are <br /> administered by the Town of Carrboro, enforcement efforts <br /> through the use of civil penalties , criminal penalties , or <br /> injunctive relief shall be initiated by the Town ( in the name <br /> of the County, if judicially required ) . The Town shall have <br /> the duty to defend at its own expense and shall indemnify and <br /> hold harmless, to the extent it can legally do so, Orange <br /> County, its Board of Commissioners, is advisory boards , its <br /> staff and all members of its boards and staffs, in their <br /> official and individual capacities, from any and all claims , <br /> actions, proceedings, expenses , damages or liabilities , <br /> including attorneys fees and court costs , resulting from the <br /> Town administration of the ordinances specified in Section <br /> 2. 1 B . <br /> C. Orange County shall notify the Town and the Town <br /> shall notify Orange County as soon as practicable thereafter , <br /> of any such claim, action or proceeding . <br /> Section 2.6 Text and Map Amendments . <br /> A . Any proposed amendments to the Land Use Plan and <br /> Orange County zoning Atlas applicable to the Joint Planning <br /> Area shall require County approval . The process shall be in <br /> accordance with adopted Orange County procedures and shall <br /> include referral to the governing body and planning board of <br /> the Town for review and recommendation . Such review and <br /> recommendation on proposed amendments shall occur before the <br /> Board of Commissioners makes a final decision . <br /> B. Whenever Carrboro amends the Carrboro Land Use <br /> Ordinance referenced in Sections 2. 1 B, it shall refer such <br /> amendments to Orange County with a request that the County <br /> make corresponding changes as expeditiously an as reasonably <br /> possible so that the Town may continue to enforce within its <br /> respective portions of the Urban Transition Area the same <br /> standards that it enforces within its own regulatory juris- <br /> diction . <br /> -4- <br />
