015 <br /> JOINT PLANNING AGREEMENT <br /> DRAFT <br /> November 3, 1986 <br /> THIS AGREEMENT, made and entered into this day of <br /> 198-.--, by and between the COUNTY OF ORANGE, a political <br /> subdivision of the State of North Carolina, and the TOWN OF <br /> CARRBORO, a municipal corporation duly created and existing <br /> under the laws of North Carolina . <br /> WiTNESSETH: <br /> In consideration of the public benefits expected to flow <br /> from the cooperative efforts of the parties in establishing a <br /> coordinated and comprehensive system of planning within their <br /> respective areas of public concern, the parties to this <br /> Agreement hereby mutually agree as follows : <br /> ARTICLE 1 . PURPOSE, DEFINITIONS, EFFECTIVE DATE <br /> Section 1 . 1 Purpose of the Agreement. <br /> The purpose of this agreement Is to establish a method <br /> of coordinated and comprehensive <br /> County-Carrboro Joint Planning Area, pasndefinednherein .Orange <br /> Section 1 .2 Definitions . <br /> A. The term "joint planning area" as used <br /> agreement refers to that area lying In this <br /> g outside the extra <br /> ro <br /> terri - <br /> torial planning Jurisdiction of Carrboro boundary designated on the maptattachedtto (this <br /> agreement as Exhibit A and incorporated herein. The <br /> also refers to the area shown on modifications of ExhibitrA <br /> if the Joint planning area boundary is amended pursuant to <br /> Section 2.5 of this agreement. <br /> B. Exhibit A shows an area where Carrboro 's interests <br /> are pre-eminent. This area is referred to throughout the <br /> remainder of this agreement as the Carrboro Joint Development <br /> Area (CJDA) . <br /> C . The terms "Urban Transition Area" refers to that <br /> area so designated on Exhibit A, as the same may be modified <br /> in accordance with the provisions of Section 2.6 of this <br /> agreement <br /> D . The term "Development Permit" means major major <br /> subdivision preliminary plat approval and any discretionary <br /> permit (whether called conditional or special use permit or <br /> some other term) issued by the Orange County or Carrboro <br /> governing bodies . <br />
