14 <br /> 0 3'; <br /> f. Whenever a person conducting a land-disturbing activity is <br /> not complying with the provisions of this Ordinance, the <br /> Grading Permit, the Approved Erosion Control Plan or any <br /> amendments to the Plan, the Erosion Control Officer may <br /> revoke the Grading Permit for the site. Notice of Revocation <br /> shall be sent by registered or certified mail to the person <br /> conducting the land-disturbing activity. in the event <br /> delivery cannot be accomplished by registered or certified <br /> mail, it may be accomplished in any manner provided in Rule <br /> 4 (j) of the North Carolina Rules of Civil Procedure. upon <br /> receipt of the Revocation Notice, the person responsible <br /> must immediately order all land-disturbing activities to <br /> cease except those which are specifically directed towards <br /> bringing the site into compliance . Once the site has been <br /> inspected and remedial work approved by the Erosion Control <br /> Division, the responsible party may reapply for a Grading <br /> Permit and pay the appropriate fee. Resumption of <br /> land-disturbing activities other than those necessary to <br /> bring the site back into compliance before the reissuance of <br /> the Grading Permit will constitute a violation of the <br /> Ordinance. The person conducting the land-disturbing activi- <br /> ty may appeal the revocation of a Grading Permit following <br /> procedures set out in Section 21 (f) of this Ordinance. <br /> Section 18 - Erosion and Sedimentation Control Plans <br /> a. An Erosion Control Plan shall be prepared for all <br /> land-disturbing activities subject to this Ordinance whenev <br /> er the proposed activity is to be undertaken on a tract <br /> comprising more than 20 ,000 square feet, if more than 20, 000 <br /> square feet are to be uncovered. The Plan shall be filed <br /> with the Erosion Control Officer and the Orange or Durham <br /> County (as applicable) Soil and Water Conservation District, <br /> 30 days prior to the commencement of the proposed activity. <br /> If the land-disturbing activity involves 20, 000-40,000 <br /> square feet and meets the requirements under Section 17 (b) , <br /> the Applicant may apply for a Plan Waiver, which does not <br /> require a formal Erosion Control Plan. <br /> b. The Orange or Durham County Soil and Water Conservation <br /> District, within 20 days of receipt of any plan, or within <br /> such additional time as may be prescribed by the Chapel Hill <br /> Town Council, or such other body or officer designated by <br /> the Council, shall review such plan and submit its comments <br /> and recommendations to the Erosion Control officer. Failure <br /> of the District to submit its comments and recommendations <br /> to the Erosion Control Officer within the prescribed time <br /> will not delay final action on the plan. <br />
