Al <br /> O2'1, <br /> AN ORDINANCE ADOPTING SOIL EROSION AND SEDIMENTATION REGULATIONS <br /> (86-9-22/0-2) <br /> WHEREAS, the Town Council of Chapel Hill, North Carolina recog- <br /> nizes a great need to control soil erosion and sedimentation and <br /> those activities which result in erosion and sedimentation within <br /> Chapel Hill and within areas affecting the Town; and <br /> WHEREAS, the North Carolina General Assembly, through Chapter 392 <br /> of the Session Laws of North Carolina, 1973, and other laws, has <br /> delegated to local governments the power to control such erosion <br /> and sedimentation; and <br /> WHEREAS, Town Council desires to exercise such power; <br /> NOW, THEREFORE, BE IT ORDAINED by the Town Council of Chapel <br /> Hill: <br /> Section 1 - Title <br /> This ordinance may be cited as the Chapel Hill Soil Erosion and <br /> Sedimentation Control Ordinance. <br /> Section 2 - Purposes <br /> This Ordinance is adopted for the purposes of; <br /> (1) Regulating the clearing, grading, excavation, filling and <br /> manipulation of the earth and the moving and storing of <br /> waters in order to: control and prevent accelerated soil <br /> erosion and sedimentation, prevent the pollution of water, <br /> prevent damage to public and private property, maintain the <br /> balance of nature, prevent the obstruction of natural and <br /> artificial drainageways, inhibit flooding and reduce the <br /> undermining of roads and other transportation facilities. <br /> (2) Establishing procedures through which these purposes can be <br /> fulfilled. <br /> Notwithstanding the provisions of Section V herein, the Town <br /> Council hereby declares its intent that all of the departments <br /> and agencies of the Town of Chapel Hill, its contractors and <br /> subcontractors shall comply with the regulations set forth in <br /> this Ordinance. <br /> Section 3 - Definitions <br /> As used in this Ordinance, unless the context clearly indicates <br /> otherwise, the following definitions apply: <br /> Accelerated Erosion - means any increase over the rate of natural <br /> erosion as a result of land-disturbing activities. <br />
