In my <br /> June 9, 1986 letter I made the point that a. road . <br /> maintenance agreement which is recorded at Book 294, <br /> Page 428 and another road maintenance agreement <br /> recorded at Book 302, Page 503 of the Orange County <br /> Registry both declare the road in question to be a , <br /> private road and require adjoining property owners- to <br /> maintain it to North Carolina 54. In fact, Glovenia <br /> Harris, Jimmie Gates and Gloria Gates, all signers of <br /> the affidavit accoupanying Grainger Barrett's letter <br /> declaring the road to be public were declarants in the <br /> road maintenance agreement which declared the road to <br /> be private and providing for its maintenance to North <br /> Carolina 54. It seems to me, based on all of this <br /> that Orange County must take the position that the road <br /> is a private road from North Carolina Highway 54 north <br /> until and unless a court declares it to be a <br /> • neighborhood public road. <br /> I restate here that, as a private iOad, Jack Gate; <br /> • Lane must be maintained from N.C. Highway 54 to its <br /> termination at the northern boundary of the property <br /> now or formerly owned by Jack Gates and that the most <br /> recent road maintenance agreement involving Shirley <br />
