• <br /> JOINT PLANNING AGREEMENT <br /> Uwe DRAFT <br /> September 16p 1986 <br /> September 19p 1986 <br /> • September 22, 1986 <br /> October 8, 1986 <br /> THIS AGREEMENT, made and entered into this day _ <br /> of . 198,_-, by and between the COUNTY OF ORANGE, a <br /> political subdivision of the State of North Carolina, and THE <br /> TOWN OF CHAPEL HILL, a municipal corporation duly created and <br /> existing under the laws of North Carolina. <br /> WITNESSETH: <br /> In consideration of the public benefits expected <br /> to flow from the cooperative efforts of the parties in <br /> establishing a coordinated and comprehensive system of planning <br /> within their respective areas of public concern, the parties to <br /> this Agreement hereby mutually agree as follows:. <br /> ARTiCLE 1 . PURPOSE, DEFINITIONS, EFFECTIVE DATE <br /> Section 1 .1 Purpose of the Agreement <br /> The purpose of this Agreement is to establish a method <br /> of coordinated and comprehensive planning in the Orange <br /> County-Chapel Hill Joint Planning Area, as defined herein. <br /> Section 1 .2 Definition of Joint Planning Area <br /> A. The term "Joint Planning Area" as used in this <br /> Agreement refers to that area lying outside the extraterritorial <br /> planning Jurisdiction of Chapel Hill but within the joint <br /> planning boundary designated on the map attached to this <br /> Agreement as Exhibit A and incorporated herein. The terns also <br /> _ refers to the area shown on modifications of Exhibit A if the <br /> Joint planning area boundary is amended pursuant to Section 2.6 <br /> of this Agreement. <br /> B. Exhibit A shows an area where Chapel Hill 's interests <br /> are pre-eminent. This area is referred to throughout the <br /> remainder of this agreement as the Chapel Hitt Joint Development <br /> Area (CHJDA) . <br /> C. The terms "Ten-Year Transition Area" and Twenty Year <br /> Transition Area" refer to those areas so designated on Exhibit A, <br /> as the same may be modified in accordance with the provisions of <br /> Section 2.6 of this Agreement. <br /> Section 1 .3 Effective Date and Duration <br /> A. This Agreement shall become effective on the effective <br /> date of an Orange County ordinance adopting this Agreement and an <br /> ordinance that amends Orange County 's Zoning Ordinance ( including <br /> Zoning Atlas) and Subdivision Regulations as prescribed to <br /> • <br />
