Durham, NC 27707 <br /> Re: Allen and Doris Turner Rezoning - <br /> Dear Mr. Embree: - <br /> In reviewing the . application ' for the -Allen and :Doris Turner <br /> . rozoning . request, I have found- two major Items that must- be - -- - <br /> addressed .In April of • this year a site plan was submitted for-this <br /> • property. This site plan showed the property located in the <br /> Major Transportation Corridor had been clear cut and graded. <br /> The planting dates as indicated on this plan have not been <br /> -complied with, therefore, a new plan with new dates must be <br /> submitted . The plan must also indicate the areas that have <br /> • been cleared and areas that are :-present i y ,wooded. To - comply - <br /> with. the Zoning Ordinance these plantings must be done <br /> immediately. If . it is impossible to plant immediately an <br /> estimate may be submitted for the plantings. Along with this <br /> estimate an escrow agreement or irrevocable letter of credit <br /> must be submitted for the amount of the estimate plus 10%. <br /> . •This agreement . or letter of credit would be valid for one <br /> year from the date of • approvai of the site plan. _ When the . <br /> plantings are completed by the developer the money in the <br /> escrow agreement or letter of credit would be released. If <br /> the plantings were not completed within this period of <br /> Orange County would be able to obtain this money to complete - <br /> the plantings required . <br /> The second item that must be addressed is an Erosion. Control <br /> Plan . The Erosion Control Ordinance requires an Erosion <br /> Control Plan when 20,000 sq. ft. -of land Is graded. Please <br /> • <br /> • <br />
