09t <br /> (5) Outstanding special assessments, if any, for public improvements such as <br /> streets, sidewalks, public utilities, and similar public facilities; <br /> (6) The amount of real estate taxes for the current year and the assessed <br /> valuation stated separately for land and for improvements. <br /> SECTION V <br /> TIME OF PERFORMANCE <br /> The preparation and delivery of the required appraisal reports by the <br /> APPRAISER, as outlined in the applicable sections of this agreement, shall be <br /> completed within thirty (3o)calendar days after the APPRAISER has received a <br /> Notice to Proceed issued by the COUNTY. <br /> It is understood by the parties to this agreement that the time within <br /> which the work is to be performed is of primary importance and of the essence <br /> of this agreement. The APPRAISER will proceed with the work outlined herein <br /> in such sequence and order as to the different parcels as the COUNTY may, in <br /> writing, direct, and will furnish and deliver the appraisal reviews and price <br /> recommendations to the COUNTY as soon as completed. <br /> In the event unforeseen delays, or additional requests for work, cause <br /> this performance deadline to be exceeded the COUNTY and the APPRAISER shall <br /> establish a mutually agreeable written extension which shall be negotiated and <br /> incorporated as an addendum to this agreement. <br /> SECTION VI <br /> MAXIMUM COMPENSATION PAYABLE <br /> The COUNTY shall compensate the APPRAISER for the services rendered under <br /> this agreement on the following basis: <br /> - 1. For the basic services described in SECTION III, exclusive of those <br /> services rendered in accordance with any other sections of this agreement, the <br /> APPRAISER shall receive total maximum compensation not to exceed $5,000.00 <br /> In the event unforeseen circumstances result in the <br /> COUNTY desiring additional services whose cost is in excess of the total maximum <br /> compensation payable hereabove, a mutually agreeable written addendum to increase <br /> the maximum compensation payable shall be negotiated and incorporated into <br /> this agreement. <br /> 2. The specific fees to be charged by the APPRAISER and paid by the <br /> COUNTY shall be in accordance with Exhibit B - Fee Schedule, which is attached <br /> to this agreement. <br /> 3. For additional services to be rendered by the APPRAISER for supplementary <br /> parcels added to this agreement, in the same manner as described previously, <br /> the APPRAISER shall receive additional compensation at the rates shown on Exhibit <br /> B attached to this agreement. Such services shall be submitted to the COUNTY <br /> within the same timeframe as outlined previously in SECTION V. <br /> 4. For services as an expert witness for the COUNTY in judicial proceedings, <br /> including formal pre-trial conferences, as provided with respect to any property <br /> appraised by the APPRAISER pursuant to this agreement, the APPRAISER and the COUNTY <br /> hereby agree that the fair and reasonable compensation for the APPRAISER'S services. <br /> shall be at the rate of$100.00 per day for each day of court testimony and/or <br /> pre-trial conference. In the event such attendance shall be for one-half day <br /> or less, compensation shall be made on the basis of for such half-day. <br /> The payments outlined above shall be made to the APPRAISER by the COUNTY <br /> subject to completion of the required service appropriate recognition by the <br /> court of the APPRAISER as an expert witness and the receipt of an appropriate <br /> requisition. <br /> -10- <br />
