ORIGINAL <br /> SECTION 0021 FORM OF CONSTRUCTION CONTRACT <br /> THIS AGREEMENT, made the 19th day of August in the year <br /> of 1986 by and between Process Plumbing and Piping, Inc. , <br /> P.O. Box 25188, Raleigh, North Carolina, hereinafter called <br /> the Contractor and the Orange County hereinafter called the <br /> Owner. <br /> WITNESSETH: <br /> That the Contractor and the Owner for the consideration <br /> herein named agree as follows: <br /> 1. Scope of Work: The Contractor shall furnish and <br /> deliver all the materials, and perform all of the <br /> work in the manner and form as provided by the <br /> following enumerated plans, specifications and <br /> documents, which are attached hereto and made a <br /> part thereof as if fully contained herein: <br /> Advertisement, Instructions to Bidders, General <br /> Conditions, Supplementary General Conditions, <br /> Specifications, Accepted Proposal, Contract, <br /> Worker's Compensation, Public Liability, Property <br /> Damage and Builder's Risk Insurance Certificates, <br /> and Drawings, entitled: <br /> Carr Building Renovation <br /> Consisting of the following sheets: A1.1, A2.1, <br /> A2,2, A3.1, A4.1, A5.1, Ml, P1, SW1, SW3, SW4, SW5 <br /> Dated: and the following addenda: <br /> Addendum No. _1 Dated 6-19-86 Addendum No. Dated <br /> Addendum No. Dated _ Addendum No. Dated <br /> Addendum No. Dated Addendum No. Dated <br /> Addendum No. Dated Addendum No. Dated <br /> 2. That the Contractor shall commence work to be <br /> performed under this Agreement on a date to be <br /> specified in a written order of the Owner and shall <br /> fully complete all work hereunder within 180 (One <br /> Hundred Eighty) consecutive calendar days from said <br /> date. For each day in excess thereof, liquidated <br /> damages shall be as stated in Supplementary General <br /> Conditions. The Contractor, as one of the consider- <br /> ations for awarding of this Contract, has furnished <br /> to the Owner a construction schedule setting forth <br /> planned progress of the building broken down by the <br /> various divisions or part of the work and by <br /> calendar days. In the event that the progress of <br /> the work is not maintained on schedule by the <br /> Contractor, or in the event the work is not <br /> completed within the time above specified, the <br /> Owner may upon fifteen (15) days notice, sent by <br /> Registered Mail, to the Contractor declare this <br /> Contract in default, and, thereupon, the Owner <br /> shall have the right to let the work remaining to <br /> be done to some other Contractor, either by public <br /> letting or negotiation, and thereupon the <br />
