7:.GEND2 ITEM fi 7 : SUBDIVISION APPLICATIONS, 015
Yuhasz stated he would be abstaining from ageCa jtems
#7 brclrerhrj due to professional conflict of interest.
` , a. Gene and Brenda Ray -- Partial Width ROT7
Presentation by Collins.
The purpose of this agenda item is to consider a
request for a partial width right-of-way of 30 }e,:
for a distance of appr.oxir;a.telyT 100 feet to G-,_r-ve a
one lot minor- subdivision on a lot known as Biltg.n6:n
Township--Map 5 Lots 14C & 14H (the Gene & Bt:'nda
Ray Subdivision) .
The Rays propose to create one new lot to be served
by a Class C road. A partial width right-of--way is
needed beca,‘se there is an existing dwelling that
could not meet the required 20 foot setback. The
Rays cannot acquire additional footage or alterna-
tive access from the neighboring lots. This is tho
last subdivision of this lot as the soil is only
suitable for three dwellings.
Approval of this request would allow a minor
subdivision of one lob for their son.
Collins noted that this application meets the
requirements for a partial width. right-of--way.
Kizer indicated he thought it would be eusiar in
the long run to ask for a variance in the setback
regulations for the house. Collins responds.d that
by granting a partial width right-of-way 'chc end
result would be a conforming house. which •rout
the
e tisC.bh:.'s! requi.ren'l'-:J. Granting;
would re-_ ult in a house which would
encroach into the right--of---way. Collins note that
there had been such cases previously so a predsnt
was not being set.
MOTION: Kizer moved approval. Seconded by Shanklin.
O E
