DocuSign Envelope ID:28DA00F8-4193-4A09-B5AF-6D4761 A9B655 <br /> NORTH CAROLINA <br /> ORANGE COUNTY CONTRACT AMENDMENT #1 <br /> THIS CONTRACT AMENDMENT ("Amendment") is made and <br /> entered into this 16th day of September 2016 by and between ORANGE <br /> COUNTY (hereinafter referred to as "Owner") and Four Star Petroleum <br /> Services, Inc., (hereinafter referred to as"Contractor"). <br /> WITNESSETH: <br /> THAT WHEREAS, the Owner and Contractor entered into a contract <br /> dated September 1 6, 2 0 1 5 for the construction services of the <br /> Contractor to the Owner(hereinafter the "Original Agreement"),; and <br /> WHEREAS, the Owner and Contractor desire to amend the Original <br /> Agreement while keeping in effect all terms and conditions of the Original <br /> Agreement not inconsistent with the terms and conditions set forth below. <br /> NOW THEREFORE, for and in consideration for the mutual covenants and <br /> agreements made in the Original Agreement and herein, the parties agree to <br /> amend the Original Agreement as follows: <br /> 1. The Term of the Original Agreement in Section 1 is hereby extended <br /> through December 31, 2016. <br /> 2. The maximum amount payable in Section 2 is amended to read: Dollar Amount <br /> Not to Exceed: Forty-Four Thousand Two Hundred and Forty Four Dollars and <br /> Three Cents ($44,244.03). <br /> 3. Section 3, SERVICES is deleted and a new Section 3 inserted as follows: <br /> 3. SERVICES <br /> Contractor agrees to provide the following construction services (the "Work") <br /> • Obtain permits, if needed, and invoice the cost of the permit, professional <br /> and / or engineering fees and labor to procure them to the customer <br /> (labor cost of$40.00 per hour plus mileage of$0.65 per mile). <br /> • Remove the existing AST equipment off of the tank and relocate to a new <br /> site. <br /> • Excavate a pad area 31'x 15'x 8" and form with #8 rebar on 18" centers <br /> both ways. <br />
