Section 1. There is hereby imposed and levied within Orange County <br /> the one-half per cent (1/2%) supplemental local government sales and use <br /> tax authorized by Ratified Chapter 906 of the 1985 Session Laws (Regular <br /> Session, 1986) , and codified as Article 42 of Chapter 105 of the General <br /> Statutes of North Carolina, effective July 7, 1986. The tax hereby <br /> imposed and levied shall apply to the same extent and be subject to the <br /> same limitations as are set forth in said Chapter 906. <br /> Section 2. Collection of the tax by the North Carolina Secretary <br /> of Revenue, and liability therefore, shall begin and continue on and <br /> after the first day of September, 1986. <br /> Section 3 . The net proceeds of the tax levied herein shall be <br /> distributed by the Secretary of Revenue as provided by law. <br /> Section 4. This Resolution shall become effective upon its <br /> adoption and a certified copy hereof shall be delivered to the North <br /> Carolina Secretary of Revenue. <br /> Adopted this 23rd day of July, 1986. <br /> VOTE: UNANIMOUS. <br /> 2. WATER CONSERVATION ORDINANCE (SECOND READING) <br /> (The Drought Management Plan is on page of these <br /> minutes) <br /> Motion was made by Commissioner Carey, seconded by <br /> Commissioner Marshall to amend the existing Water Conservation Ordinance <br /> with the addition of paragraph 2 under Article 2 (as stated below) and <br /> the adoption of the drought management plan as presented by the County <br /> Manager. <br /> ARTICLE 2 PARAGRAPH 2 <br /> "With wri ten approval by the Orange County Manager transfer s <br /> limitations may be waived on a temporary basis in order to comply with <br /> physical system limitations which require the transfer of larger <br /> quantities, when an exception is granted the water transferred in any <br /> one transfer shall not exceed the sum of seven times the daily transfer <br /> limitations for the user. The water transferred weekly to the user <br /> requesting an exception shall not exceed the water usage/allocation <br /> limit for the user established in Table II. The user requesting the <br /> transfer exception shall give written substantiation of the need for the <br /> exception with its request. " <br /> VOTE: UNANIMOUS, <br /> Chair Don Willhoit stated that Mayor Sheffield expressed concern <br /> that the Ordinance does not permit the Town of Hillsborough to transfer <br /> water to OWASA when the Alert Stage is reached. Willhoit requested <br /> that the County Attorney draft an amendment to the Ordinance that would <br /> allow for the transfer of water under certain conditions. <br /> Geoffrey Gledhill explained that the amendment would permit the 1 <br /> transfer of water to OWASA up to 1/2 million gallons a day during ACTION " <br /> STAGES II-VI when the number of usable days of water remaining from all <br /> other water sources available to OWASA is less than the number of days <br /> remaining in the water supply of Lake Ben Johnston, Corporation Lake and <br /> Lake Orange and the number of usable days would be computed on the basis <br /> of the allocations that are in the table including instream flow. <br /> Commissioner Marshall expressed concern that OWASA has not provided <br /> the figures requested by NRCD last March and if the amendment is <br />
