Dom' Lion of„ �`p��serYeticn Areas <br /> ++wr.rr�rr..ww� <br /> Existing trees , regardless of size , shall not be cut or <br /> otherwise damaged or destroyed within a primary tree <br /> protection area , and existing trees having a diameter of <br /> one (1 ) foot or greater shall not be cut , damaged or <br /> destroyed within a secondary tree protection area <br /> defined as follows: <br /> (a) Primary Tree Protection Area . That portion of a <br /> subdivision or any lot therein which is to be used <br /> for required recreation or open space area ; front , <br /> rear and side yard setback areas ; and/or buffer <br /> requirements of this Ordinance or the Orange County <br /> Zoning Ordinance . In unzoned townships , a forty <br /> (4D) foot front yard setback shall be provided <br /> adjacent to a street right-of-way Line for the <br /> preservation of existing trees . A twenty ( 20) foot <br /> setback shall be provided along side and rear <br /> property Lines for the same purpose . <br /> (b ) Secpndgry Tree Protection Area . Any portion of e <br /> subdivision or any Lot therein not included within <br /> the Primary Tree Protection Area . <br /> IV-B-8-b-2 . Exceptions <br /> Upon approval of a final plat for a minor subdivision , <br /> or a preliminary plat for a major subdivision , existing <br /> trees may be removed only from designated street rights- <br /> of-way and utility end/or storm water drainages <br /> easements . <br /> In cases where the retention of existing trees would <br /> create unusual hardship or development problems in <br /> building sites , recreation , open space , setback and/or <br /> buffer areas , the Planning Director or his/her designee <br /> shalt determine when such hardships exist and may <br /> designate that certain areas be planted with new <br /> vegetation in lieu of preserving existing trees . The <br /> Planning Director or his/her designee may approve the <br /> planting of new trees if one or more of the following <br /> conditions exist : <br /> ( a) Necessity to remove trees which pose a safety <br /> hazard to proposed bui Ldings ; <br /> (b ) Necessity to remove diseased trees or trees <br /> weakened by age , storm , fire or other injury ; <br /> ( c) Necessity to remove trees in order to construct <br /> proposed improvements as a result of the need for <br />
