Agp1igabili .X In every subdivision, school sites may be reserved in accordance with the adopted Land_Uaa_P1an for Orange County. For authorization to reserve school sites to be effective , the Board of Commissioners , prior to the adoption of the LanA_ 1E1 Plan or any amendment thereto, shall have jointly determined with the Board of Education having jurisdiction over the area, the specific location, size and suitability of each school site to be reserved. All sites so designated shall appear in the Lalla_UIR Plan. IV-B-7-a-2. M1hQh.-Ql_allaLYat i on Whenever a subdivision which includes part or all of a school site to be reserved is submitted for approval , the Planning Board and the Board of Commissioners shall immediately notify the Board of Education having jurisdiction over the area. The Board of Education shall promptly decide whether it wishes the site to be reserved and shall notify the Planning Board and Board of Commissioners of its decision. If the Board of Education does not wish the site to be reserved, no site may be reserved. If the Board of Education does wish the site to be reserved, the subdivision may not be approved without the reservation and without the school site being designated on the subdivision plat as such. The Board of Education must acquire the school site either by purchase or by exercise of the power of eminent domain within eighteen (18) months after the date the site is reserved. If the Board of Education has not purchased the site or begun proceedings to condemn the site within the eighteen (18) months , the subdivider may treat the land as freed of the reservation.
