04r <br /> 2. The Contractor shall not execute an agreement with any subcontractor or <br /> permit any subcontractor to perform any work included in this agreement <br /> or assign any interest in same, without the prior written approval from <br /> the County. <br /> 3. Except as otherwise specifically stated in this Agreement, the Contractor <br /> shall provide and pay for all materials, labor, tools, equipment, water, <br /> light, heat, power, transportation,.superintendence, temporary construc- <br /> ~ <br /> tion of every nature, charges, levies, fee or other expenses, and all other <br /> services and facilities of every nature whatsoever necessary for the <br /> performance of this Agreement and to perform all work specified in this <br /> agreement complete in every respect within the specified time. <br /> 4. The Contractor shall be responsible for all damages to person or property <br /> that occur-as a result of his fault or negligence in connection with the <br /> prosecution of the work and. shall be responsible for the proper care and <br /> protection of all materials delivered and work performed until completion <br /> and final acceptance, whether or not the same has been covered in whole <br /> or in part by payments made by the County. <br /> 5a. The Contractor shall exercise proper precautions at all times for the <br /> protection of persons and property and shall be responsible for all damages <br /> to persons or property, either on or off the site, which occur as a result <br /> of his prosecution of the work. The safety provisions of applicable laws <br /> and building and construction codes shall be observed and the Contractor <br /> shall take or cause to be taken such additional safety and health measures <br /> as the County may determine to be reasonably necessary. Machinery, <br /> equipment and all hazards shall be guarded in accordance with the safety <br /> provisions of the "Manual of Accident Prevention in Construction" published <br /> by the Associated General Contractors of America, Inc. , to the extent that <br /> such provisions are not in conflict with applicable laws. • <br /> 5b. The Contractor shall indemnify and save harmless the County and its Communi- <br /> ty Development Program for damages resulting from property damage, personal <br /> injury and/or death suffered or alleged to have- been suffered by a person <br /> as a result of any work conducted under -this Agreement. <br /> 6. Although the County shall locate, identify and mark all trees and scrubs <br /> to be protected during the performance of this agreement and assist the <br /> Contractor as much as possible in this effort the final responsibility <br /> shall rest with the Contractor. Should any such trees and scrubs be un- <br /> necessarily damaged through proven and observable negligence on the part <br /> of the Contractor the cost of comparable plant material shall be determined <br /> -6- <br />
