SECTION IV: COUNTY RESPONSIBILITIES 044 <br /> THAT the performance of the work by the Contractor as outlined in SECTION I <br /> of this Contract shall be based on the following responsibilities of the County: <br /> 1. The County shall mark or identify in some mutually acceptable fashion <br /> any trees, structures, or vegetation within the confines of the property <br /> which shall not be unduly disturbed or damaged by the Contractor prior <br /> to the initiation of any demolition 'or lot clearance work. <br /> 2. The County shall assist the Contractor in the location of property re- <br /> ferences points by providing a map, marked as Exhibit B. which shall <br /> designate the boundaries of the property within which the Contractor <br /> shall perform his demolition and lot clearance work, and if necessary <br /> the County shall actually show the Contractor, the location of pro- <br /> perty reference points by visiting the property site. <br /> 3. The County shall obtain any and all necessary approvals and permissions <br /> from property owners for the performance of the demolition and lot <br /> clearance work by the Contractor. <br /> 4. The County shall arrange for the removal of any and all electrical <br /> service drops prior to the demolition work. <br /> 5. The County shall make available to the Contractor any other information <br /> • or records in their possession which would assist the Contractor in <br /> the performance'of his work under this agreement. <br /> 6. The County shall provide all necessary information to the Contractor re- <br /> garding its requirements or any changes as expeditiously as necessary <br /> for the orderly progress of the work. <br /> SECTION V: CONTRACTOR RESPONSIBILITIES <br /> THAT the performance of the work by the Contractor as outlined in SECTION I <br /> of this Contract shall be based on the following responsibilities of the <br /> Contractor: <br /> 1. If, through acts or neglect on the part of the Contractor, any other <br /> Contractor- or any subcontractor shall suffer loss or damage on the work, <br /> the Contractor shall settle with such other Contractor or subcontractor <br /> by agreement or arbitration, if such other Contractor or sub-contractor <br /> shall assert any claim against the County on account of any damage alleged <br /> to have been so sustained, the County will notify this Contractor, who <br /> shall defend at his own expense any suit based upon such claim, and, if <br /> any judgment or claims against the County shall be allowed, the Contractor <br /> shall pay or satisfy such judgments or claim and pay all costs and expenses <br /> in connection therewith. <br /> -5- <br />
