BONNER D.SAWYER Hillsborough, NC 27278 <br /> (1902-1972) <br /> Re: Cable Television Franchising in <br /> Orange County <br /> Dear Ken: <br /> This letter is in response to yours dated May 5, <br /> 1986 which concerns a request to Orange County by Alert <br /> Cable _T.V. of North Carolina, Inc. for an amendment to <br /> - its "preexisting permitted use franchise." Some facts <br /> you may need to know are as follows: <br /> 1. The franchise ordinance granting Alert a pre-- <br /> existing permitted use franchise was adopted by Orange <br /> County on February 23, 1981. <br /> 2. That franchise ordinance imposed no <br /> limitations whatsoever on the facilities, equipment or <br /> service provided by Alert. <br /> - 3. The franchise limits only the number of homes <br /> served. Alert may not extend its coverage beyond the <br /> homes served by it on November 20, 1980. <br /> 4. There is also a limitation in the franchise <br /> :� ordinance concerning rates, which must be reasonable. <br /> 5. The effective date of Alert's franchise is - . <br /> '' May 12, 1982. That is the date that all documentation <br /> _s was completed for acceptance of the preexisting <br />-- permitted use franchise. <br /> f� <br />. ; 6. Alert's franchise is fifteen years in <br /> ,` duration with a ten-year renewal. <br />
