Smith <br /> responded that NCDOT will not accept an unconstructed <br /> dedicated right-of-way. She noted that the County <br /> Attorney is going to recommend to the Board of County <br /> Commissioners that they accept these public dedications <br /> without maintenance responsibilities. There 1s case law <br /> that supports this action so that the County could accept <br /> the public dedication of a reserved right-of-way and not <br /> get into the issue of whether DOT will sign off on the <br /> plat. Smith noted that it is a common planning practice <br /> to require the construction of a public road across the <br /> frontage of the owner doing the subdivision so that the <br /> next person then subsequently extends it across their lot. <br /> Jacobs noted that the applicant has no objection to <br /> dedication of the right-of-way. <br /> Jacobs asked about Recreation and Parks comments about the <br /> stream. Smith responded this was a drainage swale not a <br /> stream as verified on the USGS maps. <br /> Shanklin recommended an amendment to the motion to delete <br /> the reference to Nancy Williams Lands and insert lots 18 <br /> and 19. Smith recommended that this condition be left as <br /> is and a condition added stating "that the cul -de-sac be <br /> pulled back to serve lots 18 and 19 with a dedicated <br /> right-of-way extended from that cul -de-sac to the edge of <br /> the property." <br /> MOTION: Shanklin moved to amend the motion as recommended by Smith <br /> adding condition #7.
