106 <br /> ORIGINAL DRAFT: 10-8-85 <br /> REVISED: 1-9-86 <br /> 1-22-86 <br /> 1-30-86 <br /> IV-8-7-b 4-23-86 <br /> RIDS-2111211 Areas <br /> IV-B-7-b-1 . �RR1iQghil.ixX <br /> Every person, firm or corporation who subdivides land <br /> for residential and/or non-residential purposes shall <br /> be required to dedicate a portion of such land for the <br /> purpose of public recreation and/or open space areas <br /> to serve the leisure needs of the residents of the <br /> subdivision and/or preserve significant natural <br /> features and cultural resources . In all cases , the <br /> Recreation and Parks Advisory Council shall review <br /> and make recommendations to the Planning Board and <br /> Board of Commissioners on the provision or <br /> dedication of recreation and/or open space areas . <br /> The dedication of recreation and/or open space areas <br /> shall not be required for a minor subdivision; <br /> provided, however, the provisions of Article <br /> IV-B-7-b-6 (Payments In Lieu of Dedication) <br /> shall apply at the time of approval of a major <br /> subdivision to all lots previously created through <br /> the minor subdivision process following the <br /> effective date of these provisions . <br /> IV-B-7-b-2 . Dinlenligna1._Reauirement,s. <br /> At least one thirty-fifth (1/35) of an acre shall <br /> be dedicated for each dwelling unit planned or <br /> provided for in the subdivision plan, except <br /> where land is located in the flood plain of a stream <br /> or river as indicated by the flood plain maps of the <br /> Federal Insurance Administration and/or is charac- <br /> terizd by steep slopes (15% or greater) , then at <br /> least one twentieth (1/20) of an acre of such land <br /> shall be dedicated for each dwelling unit . <br /> If the application of the provisions of Article 5 .1 .1 <br /> (Required Minimum Recreation Space Ratio) and Article <br /> 6 .12 (Land Use Intensity System) of the Orange County <br /> Zoning Ordinance results in a greater amount <br /> of land, then the difference between the application <br /> of the standards above and those of Article 5.1 .1 <br /> and Article 6 . 12 shall be established as private <br /> recreation for the use of the residents of the <br /> development . <br />
