Department <br /> Orange County <br /> Hillsborough, North Carolina <br /> RR: Designation of Cheyenne Drive as a <br /> pre-existing public road <br /> Dear Ms. Atwater: <br /> It is my opinion that Cheyenne Drive is a pre-existing public road. This <br /> road was dedicated.in Plat Book 8 at Page 45 dated September 16, 1959, and, of <br /> course, so recorded in the office of the Register of Deeds of Orange County, r <br /> purchased certain properties adjoining this road in reliance thereon. <br /> Further, I submit a plat which is recorded in Plat Book 40 at page 101 setting <br /> forth. that Cheyenne Drive is a pre-existing public road. Also, I submit a plat <br /> recorded in Plat Book 8 at Page 45 showing Cheyenne Drive as a dedicated public <br /> road. Further, I submit a plat entitled Subdivision of Tract 2 and Tract 3, Tract <br /> No. 5 - Section 5, Acres of Newhope which I had prepared to be recorded once <br /> this matter is approved by the Board of County Commissioners. It sets forth that <br /> Cheyenne Drive is a pre-existing public road. <br /> Further, several years ago, a notice was posted on Cheyenne Drive that <br /> "the public will take notice that pursuant to N. C. G. S. 153A-239 a public hearing <br /> will be held by the Orange County Board of Commissioners for the purpose of naming <br /> certain public, state-maintained roads". This road is not state maintained to the <br /> best of my knowledge but is public. This hearing was held at 7:30 P. M. in the <br /> Orange County Court House in Hillsborough, North Carolina. <br /> Further, on the tax map, to-wit, Tax Map 2, Chapel Hill Townshic <br /> Acres of New Hope are further referred to, to-wit, Tract 5, Section 5, recorded in <br /> Plat Book 40 at Page 101 which is referred to concerning said tract which shows <br /> on said plat that Cheyenne Drive is a pre-existing public road and so designated. <br />
