08C <br /> documentation (legal opinion) to support the <br /> public" status of Cheyenne Drive; until such <br /> certification is received, the plat should be <br /> revised to designate Cheyenne Drive as a private <br /> road and the applicant shall provide for (a) the <br /> improvement of the road to Class "B" private road <br /> standards and (b) the preparation and recordation <br /> of a road maintenance agreement. <br /> The County Attorney on May 13, 1986 confirmed that <br /> Cheyenne Drive was previously dedicated public and <br /> qualifies as a pre-existing "public" road. <br /> Board of County Commissioners policy regarding pre- <br /> existing "public" roads is to approve subdivisions <br /> served by these roads without requiring improvements <br /> to the same. The Planning Board will discuss <br /> possible policy alternatives on requiring <br /> improvements to roads determined to be pre-existing <br /> "public" through the subdivision procedures and will <br /> forward their recommendations to the Board of County <br /> Commissioners for consideration at the June meeting. <br /> The Planning Board recommends approval with the <br /> following conditions: <br /> - name of the owner be indicated on the plat <br /> - that the Board of Commissioners determine that <br /> Cheyenne Drive is a pre-existing "public" road <br /> (based on the opinion of the County Attorney) <br /> • <br />
