35. Developer shall coordinate mail service with the 'HillQ3'c <br /> borough Postmaster prior to construction of phase one of <br /> the development. (ADDED BY PLANNING BOARD 2-4-86) <br /> 36. The project shall be phased to limit construction of <br /> resiential units to a maximum of 25% of the total number <br /> of approved units within a give 2.5 year period . <br /> 37. The applicant shell request annexation by the Town of <br /> Hillsborough for each phase of the development following , <br /> the construction of required improvements. (ADDED BY <br /> PLANNING BOARD 2-4-86) . <br /> 38. A final boundary survey of the Planned Development and <br /> improvements shall be recorded by the developer. <br /> 39. The final site plan and narrative of the project <br /> incorporating , all changes, deletions And additions <br /> through the final approval of the project are incorporat <br /> ed herein and made a part of this Planned Development <br /> Special Use Permit. A copy of the final site plan and <br /> narrative are on file with the Orange County Planning <br /> Deprtment. Grading and building permits, upon applicat- <br /> ion, will be issued after approval and recordation of <br /> the Special Use Permit. <br /> 40. The development shall be built and operated according to <br /> the site plan and written narrative supplied by the <br /> developer and in compliance with or fulfillment of the <br /> above conditions and the Orange County development <br /> regulations and ordinances. <br /> 41 . If any of the above conditions shall be held invalid or <br /> void, then this approval shell be void and of no effect. <br /> THE PLANNING BOARD ADDED THE FOLLOWING CONDITIONS ON 4- <br /> 21-86: <br /> 42. The commercial area shall contain no more then 30,000 <br /> square feet floor space in either one high volume retail <br /> establishment or a series of small "boutique type" <br /> stores plus proportional service and parking areas. The <br /> remaining land previously designated as commercial floor <br /> space shall be maintained in buffers both between the <br /> shopping area and US 70 and between the shopping area <br /> and the multi-family housing. <br /> THE PLANNING BOARD DELETED THE FOLLOWING CONDITIONS 2-4-- <br /> 86: <br /> A. A traffic light shall be installed at the intersect <br /> ion of St. Mary 's Road and U.S. 70 during the <br /> development of the first phase. (A motion for <br /> deletion of the condition was approved on a 6-2 <br /> vote. ) <br /> B. A stub-out to the Guy Baldwin Jr. property shall be <br /> provided with the location to be reviewed and <br /> approved by the NCDOT. (Unanimous) <br />
