HOMESTEAD HIGHLANDS - CONTINUATION <br /> 2 Planner Susan Smith presented for receipt of input from the <br /> 3 Towns on urban services and annexation policies within the Joint Planning <br /> 4 area the request from Piedmont Atlantic Inc. for a .general rezoning of <br /> 5 property located north of Homestead Road and 400 feet west of the <br /> 6 intersection of Homestead Road and Rogers Road in Chapel Hill Township. <br /> 7 Planning Director Marvin Collins identified and reported on the <br /> 8 two issues that were discussed at the February 24 meeting" <br /> 9 (3.) How Chapel Hill and Carrboro would deal • with the <br /> 10 annexation implications associated with the tract -and <br /> 11 (2) how service agencies such as volunteer fire departments <br /> 12 would be affected by annexation of development. <br /> �3 With regard to annexation both jurisdictions have indicated it <br /> 14 would be highly desirable to adopt a mutual growth boundary beyond which <br /> 15 neither jurisdiction would annex. Both have indicated, however, that <br /> 16 adoption of such a boundary would require staff analysis first, then <br /> 17 governing board review and action. <br /> 18 With regard to service implications, the general statutes <br /> 19 provide ' a basis for mitigating the net loss to a fire district if. <br /> 20 annexation is by municipal action. If annexation occurs as a result of <br /> 21 satellite annexation by petition of the owner,- the only easing of the tax <br /> 22 situation could be accomplished through prorating of taxes or through the <br /> 23 municipality setting the effective date of annexation such that taxing by <br /> 24 a fire district and a municipality would not overlap. - <br /> " In conclusion, Marvin Collins stated that at this time nothing <br /> can be done to address these two problems. This is a rezoning request <br /> and the annexation issue needs to be resolved by Chapel Hill and Carrboro <br /> 28 to avoid questions in the future.' <br /> 29 Chair Willhoit indicated the two issues need to be resolved <br /> 30 prior to the time development requests are received. <br /> 31 WITH NO FURTHER COMMENTS THE HEARING WAS DECLARED CLOSED. <br /> 32 Motion was made by Commissioner Lloyd, seconded by Commissioner <br /> 33 Carey to refer this rezoning request for Homestead Highlands to the <br /> 34 Planning Board for further consideration and recommendation. <br /> 35 VOTE: UNANIMOUS. <br /> 36 <br /> 37 E.
