114 <br /> DRAFT PLANNING BOARD MINUTES 32 <br /> Lewis expressed concern that members of the Board <br /> have a. very Jaded view of developers. He <br /> continuted that most developers are trying to <br /> market a product; therefore, most of them will try <br /> make their product as marketable as possible, <br /> which would include saving as many trees as <br /> possible. He, added that this suggestion would <br /> limit the individual homeowner. <br /> Best suggested that the homeowners? rules and <br /> regulations could be used to enforce the concept. <br /> Smith noted that discussion at the past meeting on <br /> this condition focused on separating the <br /> responsibilities of the developer as he prepares <br /> his site for marketing from the actions of the <br /> individual property owners who purchase the lots. <br /> Jacobs noted that the suggested condition was <br /> intended to address this relationship. Smith <br /> cited the problem that the condition, as worded, <br /> applied to both. Kizer noted that should you <br /> decide the homeowners ' association can cover this <br /> it should not necessarily imply wrongdoing only on <br /> the part of the developer given that many <br /> individual property owners do not appreciate the <br /> finer things we are considering. <br /> Smith cited an example that an in-ground pool may <br /> be located in a setback and an individual property <br /> owner may wish to install a pool with its <br /> accessory features on his half-acre lot, therefore <br /> building out his site. <br /> Margison cited homeowners? association regulations <br /> setting out those restrictions. Smith commented <br /> that the county does not regulate restrictions of <br /> private associations . <br />
