He continued that <br /> these decisions effectively deny the project. <br /> MOTION: Shanklin moved positive findings on 20.3.2 a) b) <br /> (Rezoning application materials) . Seconded by <br /> Yuhasz. <br /> VOTE: Unanimous. <br /> MOTION: Shanklin moved positive findings on 20.3.2 e) <br /> (Land Use Plan) . Seconded by Yuhasz. <br /> Pilkey expressed concern in the Land Use Plan with <br /> spacing requirements for commercial uses. Lewis <br /> suggested that the commercial proposal would keep <br /> residents of the development off US 70. Best <br /> commented that there was only one access to the <br /> commercial area from the development and, <br /> therefore, this was not truly a commercial area <br /> for Scotswood. <br /> Kramer asked if the size was different would that <br /> impact Best's decision . Best responded yes. <br /> Yuhasz added that Pilkey seemed concerned with <br /> uses ie. the grocery store adding that such a <br /> facility would serve the community. <br /> Collins asked the Board members to cite the <br /> provision in the ordinance regarding spacing of <br /> commercial uses. Jacobs read Section 7. 15 . 1 of <br /> the Zoning Ordinance. Smith indicated that that <br /> provision did not set a spacing standard . <br /> VOTE: 5 in favor.
